The banter which has erupted between ace broadcaster and entertainment journalist widely known as Nana Romeo and self-acclaimed Ghana music queen Wendy Shay is an anecdote culled from allies of the former purporting that; he’s presently in the custody of the Ghana police service.
Nana Romeo in the early
minutes of an interview with Zionfelix threatened to leak recorded s*x videos
of Wendy Shay and Bullet he has on his hard drive.
In Ghana, there is no direct law on the
publication of s*x tapes, nude pictures and among others. Various provisions
however, paints a rather clear picture about the publication of obscene
materials. Provisions which are vehemently against obscenity and seek to uphold
peoples privacy and dignity as shown in Article 18 (2) of 1992
constitution of Ghana which states;
“No
person shall be subjected to the interference with the privacy of his home,
property in correspondence or communication except in accordance with the law
as it is necessary in a free and democratic society for public safety and economic
wellbeing of the country – for the protection of health, morals or crime for
the protection of the rights or freedoms of others.”
With
this, person’s sex tape can be considered as his or her property which he or
she has the right to keep in private.
Although
what constitutes morality is a contentious matter there are common similarities
in what Ghanaians believe to right and wrong and the leakage of sex tape is
undoubtedly an immoral act.
Article
15 of the same constitution also makes the dignity of all persons inviolable.
Article 33 additionally assures Ghanaians of the protection of such right by
the honourable courts.
Offences act 1960 (Act 29) criminalizes the act of publishing or offering of sale an obscene book, writing or representation and penalty being that of any demeanour and such offences is liable on conviction to a fine not exceeding GHC 50 or an imprisonment exceeding 3 months.
